IF YOU DON'T AGREE WITH ANY TERM IN THIS PRIVACY POLICY, PLEASE DO NOT USE THE SERVICE. BY DOWNLOADING, ACCESSING AND/OR PLAYING OUR GAMES, OR INTERACTING WITH OUR WEBSITES OR OTHER SERVICES, YOU AGREE TO THE COLLECTION AND USE OF YOUR INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY.
1. What kinds of information we collect from you?
1) Information may be automatically collected
When you use or access the Software and the Service, some information about you may be automatically collected. This information does not reveal your specific identity but may include: :
(1) Device information (such as type, model, version, brand, language and resolution etc.,); (2) Identifiers that relate to an individual device, browser or app (such as advertising id,UDID, Android_Id, MAC Address, etc.,); (3) operating system information(such as type, version name and version number); (4) network information (such as type,operator etc.,); (5) app activity (such as page views,click-through statistics, app interactions, other user activity or actions in-app, etc.,) ;(6) Web browsing history; (7)app information and performance (such as Crash logs, Diagnostics,etc.).
We may share the data with the third parties and use it help us optimization function and fix bugs as follows:

2) Information that you provide to us
a. Photos, GIFs and Videos. We may collect the photos, gifs, and videos when you upload from your mobile devices while using the App after your agreement. Please note, the photos with faces will be deleted automatically once the new video generated.
b. Facial Features. We may collect the facial feature data separately from your photos only to provide you with the face-swapping functionality of the APP. Please note, we collect the facial feature data that is not biometric data only with your agreement.
We will not share any sensitive data with any thirds and will deal according article 4.&5.
2. How we use your information?
1) The main reason we use your information is to deliver and improve the Service. Read on for a more detailed explanation of the various reasons we use your information:
l to operate and update the Software and the Service, and provide you with existing and new functionality and features;
l to improve and customize the Software and the Service;
l to maintain, test, monitor and improve the quality and operation of the Software;
l to notify you of the Software and the Service updates;
l to provide you with support and handle your complaints and/or feedback;
l to take any action in case of a dispute involving you in connection with the Software and the Service;
l to comply and satisfy any applicable law regulation, legal process or enforceable governmental request.
2) If any new purposes for processing your information arise we will let you know we start to process information on that other purpose by introducing the corresponding changes to this Privacy policy.
3. How We Share Your Data
We will not share any personal information that we have collected from you except for the following events:

We take appropriate measures to ensure that no user can be individually identified from the disclosure of such information, and we require these third parties (i) to keep the data secured, (ii) not to use the data for any other purpose other than to provide us with the Service; and (iii) to use the data solely in compliance with the applicable data protection laws and this Privacy Policy.
If you want to delete any personal information which we have shared with the third parties, please contact us through the email displayed below. We would try our best to notify the third party of deleting the relative personal data, but no warranty as to the deletion is made by us.
(4)Sharing with your consent.
After obtaining your consent, we will share the data that you have authorized with specified third parties or categories of third parties to the extent permitted by applicable laws and regulations.
(5)Sharing with third parties.
Our services may contain third-party content and integrations (Third-party Services) to provide you with better service. We will only share your information in the following situations-and then only the minimum information necessary：
We share your information with service providers who process data on our behalf to perform services related to our Services. For example: Apple Pay and Google Pay to complete your payment transactions when you pay for the paid services provided by us; Dropbox, Evernote, or Google Drive to sync the documents you upload as you need.
We share your information with software development kit(SDK) providers to operate, develop, and improve the features and functionality of Our Services. Google Analytics and Firebase(analytics and reporting services provided by Google)to assist us in analyzing how Our Services are used.
We share Non-Identifying Information(including the advertising identifier currently associated with your device) and other aggregated information that does not include personal information with advertisement providers. If you prefer that we not deliver ads to you, please set the preference on your mobile device to limit ad tracking. Your mobile device includes a feature that lets you opt out of some types of targeted advertising (‘Limit Ad Tracking’ on iOS and ‘Opt Out of Interest-Based Ads’ on Android), you can opt out of Audience-Based and Activity-Based targeting by turning on the ‘Limit Ad Tracking’ setting on your iOS device or the ‘Opt Out of Ads Personalization’ setting on your Android device. To learn more about how these opt-out features work, please review your device settings.
We will ensure that the lawfulness of this sharing and sign stringent non-disclosure agreements (NDAs) and/or data processing clauses with the companies, organizations, and individuals with whom the data is shared, requiring them to comply with this Privacy Policy and take appropriate confidentiality and security measures when processing the data.
4. How We Store Information
Data retention. Your data will be stored by Magic Test no longer than is necessary for the purposes for which the data are processed. That is why,
- your photos and videos are stored on the Magic Test’s server until you finish the editing session, but not longer than within 48 hours after the finishing of the editing session and delete automatically after 48 hours. For the rest of the time your photos and videos used in Magic Test application are stored locally on your mobile device and may be removed any time by either deleting these photos and videos from your mobile device’s file system directly or by deleting Magic Test application;
- your facial feature data is stored on the Magic Test server for a limited period of 14 calendar days after your last use of the Magic Test application and delete automatically after 14 days.
5. How do we protect your personal information
This platform only retains your personal information for the period necessary for the purposes described in this policy and the time limit required by laws and regulations.
Data security technical measures: The platform will adopt security protection measures that comply with industry standards , including establishing reasonable system specifications and security technologies to prevent your personal information from unauthorized access, use, modification, and avoid data damage or loss; this platform will use security technologies and procedures to monitor, record the state of network operations, network security events, and take the necessary technical measures to ensure network security, prevent information loss, misuse, unauthorized disclosure or reading. In some services, this platform will use encryption technology to protect the personal information that you provide. But please understand that due to technical limitations and various malicious means that may exist, in the Internet industry, even if every effort is made to strengthen security measures, it is impossible to always guarantee 100% security of information. You need to know, your access systems and communication networks of this platform products and services used, may be due to factors outside the scope of this platform and controllable problem.
This platform only allows employees and partners who need to know this information to access personal information, and has set strict access rights control and monitoring mechanisms for this purpose. This platform also requires all personnel who may have access to your personal information to fulfill their respective confidentiality obligations. In order to give you a better experience, and to improve products and services of this platform or for other purposes your consent, in accordance with the relevant laws and regulations, this platform may use certain information collected by certain products or services to use for other products and services of this platform by bringing together information or personal way. In a service information collected when you use in this platform, may be used to provide you with specific content in another service, or to show you non-universally pushed information related to you. If this platform provides the appropriate options related services, you can also authorize the platform and the services provided by letter stored information for other services of this platform.
6. Your management of personal information
(1) You have a right to access to your personal data and right to data portability. This means You have a right to request from the App towards your personal data in a structured, commonly used and machine-readable format.
(2)You have a right to request from the APP to rectify your personal data. This means you can require all the inaccurate personal data concerning you being corrected. You can also complete the personal data if needed.
(3)Withdraw your consent. You can withdraw your consent for the collection and processing of your personal data by us at any time by contacting us at: magictest2023@outlook.com without affecting the lawfulness of processing based on consent before its withdrawal. After we receive such withdrawal request from you, we will process it in a timely manner and we will no longer process your personal data, unless otherwise is set by law.
(4)You may share content you create by using the App, including photos, GIFs, videos (“User Content”) for publication or display on social media networks and other websites you access from the App. we cannot control the actions of third parties with whom you may choose to share your User Content. Therefore, we cannot and do not guarantee that your User Content will not be viewed by unauthorized persons, and we have no control or liability with regard to how your User Content may be used by others once you have posted or otherwise transmitted it. Therefore, Your User Content is posted and transmitted to others at your own risk.
7. European Privacy Rights
8.1 If you are a resident of the European Union, you will benefit from any mandatory provisions of the law of the country. You may have certain additional rights with respect to your personal information under the General Data Protection Regulation (Regulation (EU) 2016/679) (the “GDPR”). Nothing in this Agreement, including the paragraph above, affects your rights to rely on such mandatory provisions of local law.
8. Privacy policy concerning children
The Service offered by us are not intended for children under 13 or other statutory minimum age according to the applicable laws and regulations in your country (the “Minimum Age”). Anyone under the Minimum Age should not use the Service. With this in mind, we do not collect personal data from children under the Minimum Age. All the same, if the collection of such data is brought to the attention of us, we will take all useful measures possible to delete the corresponding data.
